The Bitch (My Tenant) Received Her Eviction Notice- She’s Not Happy

In my last blog post I was throwing my toys out of pram because I was having to evict my tenant. I had an urge to stick my tenant’s head in the meat grinder because she was a few days away from falling 2 months in arrears.

I was actually hoping she would fall into 2 months arrears so I had legal grounds to serve her with a Section 8 Notice and begin the process of evicting her dumb arse. Well, as the title blatantly suggests, the stupid tart failed to make the payments, so now I can get the ball rolling on the eviction process…

Yesterday my tenant received her eviction notice through the post. The Section 8 notice is basically a legal notification used to terminate a Tenancy Agreement during the fixed term because a tenant has breached the agreement. The notice specifies for whom the notice is for, and the exact ground which she has breached. In my tenant’s case, she breached Ground 10:

Ground 10: Any amount of rent is in arrears at the date of service of the notice and remains unpaid on the date on which the proceedings for possession are begun.

The waste of space parasite has 14 days to respond. She can either roll over and die by accepting the notice and vacate the property or if she’s feeling feisty and continues to act as stupid as she looks, she can carry on staying in the property and force me to proceed with a court order.

My Tenant’s Response After Receiving The Eviction Notice

She contacted me yesterday morning all huffy and puffy, whimpering…

I received an eviction notice

Yeah, you owe two months rent, so I have legal grounds to evict you on. I have tried getting rent from you for a while now, and you keep giving me excuses, and failing to meet your promises. What did you expect would happen? I’ve been patient, and you seem to ignore all my calls.

I heard an irritated “URGH”, and then she hung up on me like I was yesterday’s news, and today’s fish n’ chip paper! Shame.

The woman just doesn’t help herself. Running away from the issue is pointless; hanging up the phone isn’t going to help her right now. I don’t know what she expects, and the Lord only knows why she sounded so surprised/annoyed by all this. It’s like when criminals get caught, they act like injustice is being served by inflicting a penalty. What planet are these people living on?

Right, so I have just less than 14 days to wait in order to determine what my next actions will be. If she doesn’t vacate my property, then so be it. I have no qualms with taking her to court and watching her BURN IN HELL! Bearing in mind, this blood sucking cockroach is receiving social benefits, which means she’s receiving a monthly allowance from the Government to pay her rent. Where the fuck is that money going?

Are you having tenant problems?

If you’re having problems with a nightmare tenant, I would strongly advise seeking legal advice. If you feel like the entire process is out of your depth, I would recommend contacting your local Citizens Advice Bureau for free legal advice. Vipul2007-07-23 07:48:13 OK. Let me explain. If you steal something from TESCO, you get caught and you are jailed. Police action is taken. Theft is a CRIMINAL offence.

So if your tennat is not paying her rent, basically she is stealing from you and should be considered a criminal offence in my opinion.

I have been a tenant before and still am a tenant(commercial) so I can see the picture from both sides.

I think the law needs to be changed! 2

There isn't much else to report on this eviction saga to be honest. I haven't spoke to my tenant since, and she has another week to break her silence.

Additionally, i haven't been blogging about other property issues because I've been busy designing a new site during the limited spare time I have. This place should look completely different if all goes according to plan. Although, 2 weeks ago I spent a week designing a new site, and right before it was meant to go live, I had a change of heart and decided the design was shit. So back to the drawing board...

I told you, even people on benefits can be GOOD tenants, just as easily as 9-5 young professionals. I picked a rotton apple this time, and it's been a good experience, because now I know what process I need to go through in order to evict scum!!

Helen2010-06-17 20:27:16 Geeta, If you know the tenant is receiving rent allowance from the coucil and you are not receiveing rent after 2 months of none payment you can write to the coucil and have her rent benefit paid directly to you and they will. That is legal and she will get no say in the matter.

jessica2010-07-18 17:28:57 I know some people do this as a profession 2 months for the price of 1, why not? any smart landlord will do their research beforehand and take references and that way they are protected, if your too stupid to do that then what do you expect? your going to get abused simple, its your responsibility to ensure you trust the people you rent a flat too, even afte the courts serve an eviction notice you cant throw her out until the court bailifts are ready to do so. Or she'll just leave knowing she used you enough and you'll never see a penny from her. The landlords make this very easy for tenants to get away with, the law is definatley on the tenant's side but thats only because all Landlords are ARSEHOLES!!!!!!! end off 14

I understand that all of you are landlords and that it is stresfull to deal with your tenants, but I must say that language you are all using is shocking, calling your tenants "bitch", "assholes" or "blood sucking reject" and most of you are women!! You should be ashamed of yourself - first charging people a fortune for a tiny rooms/flats(normally in disputable state)and ridiculous ammount of deposit and then slugging off people who you sucking dry and who provide you more than a decent living??? The thing that piss's me off is that I pay my rent NEVER been in arrears with it over 3years, I cleared out the dump my landlord said was a garden (which meant I had to pay for skips, plants, decking, grass) I even had to put up with 6 months with NO heating and YES winter was bloody cold (it's bad when your 5year old wakes up and her lips are blue and you can see your own breath), and that's not even half off it. So I would love to know what I have done to be such a bad tenant that me and my family have to leave!!! 19

The Landlord2011-08-18 10:43:37 Ashley, a section 21 is NOT an eviction notice. Simply means the Landlord wants his/her property back when the tenancy agreement expires. There could be a NUMBER of reasons for this e.g. the landlord may want to sell the property.

Probably best to ask why the notice was served, there might be a legitimate reason. 20

max2011-10-10 07:26:20 and Ashly, call Environmental Health and get them to do an assessment. Maybe put in a claim for disrepair and claim for the money you have spend. You don't need to spend loads in lawyers just go to your local law centre and you may get legal aid depending on how much you earn. If you're child is waking up with blue lips then there is a serious problem. I obviously don't know if your notice has expired yet, or even if it has been served correctly as most aren't. But try to get a claim in asap and it will be classed as a counter claim and be dealt with in accordance with such laws. You still have rights and I suggest you find out what they are. Looking on the internet can provide a range of free organisations that can help to avoid crappy landlords that don't know anything about YOUR rights but seem to know everything about theirs.. Funny that.... 22
